HB 3007 JUVENILE CERTIFICATION;
ONLY CERTIFIED UPON CONVICTION. Patron: Dave W. Marsden
Juvenile conviction in circuit court. Provides that the juvenile court is precluded from taking jurisdiction over a juvenile for subsequent offenses only if the juvenile is convicted as an adult. Under current law once a juvenile is tried or treated as an adult for an offense the juvenile court is precluded from taking jurisdiction for subsequent offenses.

"House Bill 3007 was truly a team effort between Professor Melissa Goemann, Director of the Juvenile Law and Policy Clinic of the University of Richmond, Beth Stinnett, President of the Virginia Juvenile Justice Association (VJJA) and the Juvenile Justice Coalition. It represents one of the few times in recent years that the trend toward the expansion of trying juveniles as adults has been reversed. Fundamentally, this piece of legislation was about fairness; the idea that a juvenile found not guilty should continue to be treated as an adult was wrong and every member of the General Assembly present agreed. Governor Kaine did as well, as he signed HB 3007 into law on March 9th. There is much more to be done to make our juvenile justice system as fair and effective as it should be."
